Cuba will be the first country to submit a Family Code to popular consultation and referendum; This was stated by the Minister of Justice, Oscar Silvera Martínez, when he recently intervened in the Mesa Redonda program on national television.
He stressed that the elaboration of the Code was always a process characterized by being broad, democratic and contributing; with diverse views from science, convictions and cultural elements of the nation.
Regarding the referendum on September 25, he reiterated that it will be the first in the history of Cuba, since until now only constitutional referendums had been held.
He explained that the consultation is in correspondence with the eleventh transitory provision of the Constitution, which explains that, based on the results of the popular consultation carried out, the National Assembly of People's Power (ANPP) will have, within two years of validity of the Constitution, initiate that process and the referendum.
Article 256 of Law No. 127 of 2019 Electoral Law provides that the ANPP calls the referendum, through which citizens with electoral rights, through free, equal, direct and secret voting, express whether they ratify, approve, modify or repeal a certain legal provision, or ratify the constitutional reform referred to in Article 228 of the Constitution.
The specialized consultation of the project meant an innovation in the process of legislative creation of the country. From then on, all the legal norms derived from the intense and complex process of updating the Cuban legal system have been subjected to specialized consultations.
